Terms of Use

Agreement

These Terms of Use ("Terms") form a binding agreement between you and BMB Enterprises Ltd (Company No. 11309655, registered in England & Wales; "we", "us", "our") governing your use of the Acetate iOS application ("Acetate", "the app").

By downloading, installing, or using Acetate you agree to be bound by these Terms. If you do not agree, do not use the app.

These Terms supplement Apple's standard Licensed Application End User Licence Agreement (EULA), which also applies to your use of Acetate. Where the Apple EULA and these Terms conflict, these Terms govern, except where the Apple EULA grants rights that cannot be overridden.

Licence

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Acetate on Apple-branded devices that you own or control, for your personal, non-commercial photographic use.

Acetate is licensed, not sold. We and our licensors retain all intellectual-property rights in the app, including its source code, design, the built-in film LUTs, and the trademarks "Acetate" and the Acetate icon.

Pricing

Acetate is currently free to download and use, with no in-app purchases, no subscriptions, and no advertising. We reserve the right to introduce paid features, in-app purchases, or subscription tiers in future versions of the app. If we do, you'll be told clearly before anything is charged — features that are free today will remain free for users who already installed the app on that basis.

Acceptable use

You agree not to:

  • Use Acetate for any unlawful purpose, including capturing photos in a manner that violates other people's privacy or the law where you are using the app.
  • Reverse engineer, decompile, or disassemble the app, except to the extent expressly permitted by applicable law.
  • Modify, adapt, or create derivative works based on the app or any part of it.
  • Rent, lease, lend, sell, redistribute, or sublicense the app.
  • Use Acetate to create content that infringes anyone else's intellectual property, violates anyone's right of publicity, or constitutes harassment, hate speech, or sexual exploitation of minors.
  • Bypass or interfere with the security mechanisms of the app or any Apple service the app interacts with.

Your content

Anything you photograph, edit, save, or otherwise produce using Acetate — photos, videos, saved LUTs, captions, edits — is yours. We claim no ownership of your content. We never see it: the app does not upload your photos, your edits, or your saved LUTs to any server.

You are solely responsible for the content you create with Acetate and for ensuring you have the rights to capture and edit the subject matter of your photos.

Imported third-party LUTs

Acetate can import third-party LUT files (typically in .cube format). When you import a LUT, you represent that you have the right to use it on your device. We are not responsible for any licensing restrictions attached to third-party LUTs you import. Imported LUTs remain entirely on your device and are not shared with us.

iOS in-app permissions

Acetate requests access to your Camera, Photo Library, motion sensor, and (optionally) Location, solely to provide the in-app features described in our Privacy Policy. You can grant or revoke any of these permissions at any time in iOS Settings → Privacy & Security; revoking a permission may make some features unavailable but will not affect your previously captured photos.

Service availability

Because Acetate is fully on-device, the app continues to work without any server-side service from us. We may release updates from time to time via the App Store. We do not guarantee that any future version will maintain feature parity with the version you installed, though we do try to preserve user-saved data (saved LUTs, settings) across updates.

Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components, or that the results of using it will meet your requirements.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the Consumer Rights Act 2015 or other applicable consumer-protection law.

Limitation of liability

To the maximum extent permitted by applicable law, in no event will BMB Enterprises Ltd, its directors, employees, or licensors be liable to you for any indirect, incidental, consequential, special, or exemplary damages — including without limitation damages for lost profits, lost data, loss of goodwill, or business interruption — arising out of or in connection with your use of, or inability to use, Acetate, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded but may be limited, our aggregate liability arising under or in connection with these Terms shall not exceed the greater of (a) the amount you paid us for the app in the twelve months preceding the event giving rise to the claim, or (b) ten pounds sterling (£10).

Nothing in this section excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.

Indemnity

You agree to indemnify and hold us harmless from any third-party claim arising out of (a) your misuse of the app, (b) your breach of these Terms, or (c) your infringement of any third party's rights through your use of the app, including in particular the content you create using Acetate.

Termination

You may stop using Acetate at any time by deleting it from your device. We may terminate or suspend your licence to use Acetate at any time, without notice, if you breach these Terms. On termination, your licence ends; the disclaimer, limitation of liability, indemnity, and governing-law sections of these Terms will survive.

Changes to these Terms

We may update these Terms from time to time. If we do, the "Last updated" date at the top will change. Material changes will be announced in the app's release notes on the App Store. Continued use of Acetate after an update constitutes acceptance of the revised Terms.

Governing law and jurisdiction

These Terms are governed by the laws of England & Wales. Any dispute arising out of or in connection with these Terms or your use of Acetate shall be subject to the exclusive jurisdiction of the courts of England & Wales, save that if you are a consumer resident in another EU member state, you may also bring proceedings in the courts of your country of residence to the extent required by applicable consumer-protection law.
